Hard to say - it's been 30 odd years. Also, she has a settlement from Polanski which may affect what she's allowed to say (if she starts changing her story or what have you it could be voided). Reading between the lines, she's also offered to stand in for Polanski at the trial and a few other things that are a bit above and beyond the call for someone who is purely a victim. That's an assumption of course, there are plenty of other explanations, but that's kind of the point. We don't know.



If the prosecutor had felt that he could have made the case solidly without a plea, he'd have done so. The fact that he let all the 'serious' charges get wafted away for what amounts to a pretty minor thing says that he felt that he was on pretty shaky ground.

As to the bit about her mother and the shoots - who knows if that's even true or not. All of this info comes exclusively from the Geiner side and much of it from the Grand Jury indictment. None of it was tested in court for validity. It might all be pure BS.

Now - if you want my opinion on what I think probably happened, I think everyone was drinking, things started (and there's no way to know who started what but they wound up in a hot tub with no clothes on and no one said anything about anyone forcing that part) and then things went too far. It's quite possible that Samantha got scared and asked him to stop - or that might be the prosecutor counselling her to 'remember' it that way. It's possible that he didn't, maybe being too drunk to even realize himself.

Or it's possible that they did the wild thing entirely consensually, she regretted it later, or maybe her mom did, and she called rape. That's happened lots of times too.

It's possible no one even clearly remembers what happened that night if enough was drunk/consumed.

I DO think that what happened that night was regrettable on the part of both parties and the result of both of them making some bad decisions. That's probably why everyone but the justice system would just like to call it done and get on with their lives.

Of course, that's just my opinion, but things are way too murky for this to have been an open and shut rape case.
