They said they would never catch them and even if they did the guns would have been sold already but basically they didn't have the resources for that level of investigation in a simple robbery. As for Holmes he did build a bomb he just left it for the police. Do you really believe that if he had not been able get his hands on some guns he wouldn't have used that bomb in the theater?
