But in the united states, that third wheel that gets axed out of the legal marriage would not get the same legal benefits as the other two spouses: hospital visitation rights, joint tax filings, probate considerations in the chance that you didn't leave a will or if there is some problem with the will, etc... I can't say whether the federal government would step in if it found out they considered themselves religiously married though not legally married in the US.
