If Lindsey Graham, a former Army legal prosecutor, is worried about Miranda rights, then I'd say it's much more likely that you're the one who doesn't understand their application. Where did you go to law school, by the way?
You also fail to note that there is a difference between "military tribunal" and "no due process". The Guantanamo situation is bad and I for one do not disagree with you on that point. Yes, it does help jihadis paint themselves as victims of an oppressive United States.
However, most jihadis are going to view us that way no matter what we do. Furthermore, military tribunals which meet standards for due process, habeas corpus, etc. are perfectly legitimate and legal.
