Yeah, a lot of people were fuzzy on that till this started. The Name With No Man Send a noteboard - 20/11/2009 09:30:39 AM
I wasn't aware that due process even applied out side of "American Citizens", legally speaking.

We of course could argue the ethical standpoint all day long, but legally, I had no idea that non-Americans even got due process.

PS. i'm talking about on a domestic-law basis. I have no idea what international treaties we have with whom and how that affects due process.

Maybe not in the abortion debate though; much of that hinges on Madisons habit of stating rights held by "persons" (i.e. not citizens alone, and not just on US soil. ) Many lost sight of that in the handling of the 911 hijackers because of so called "American Taliban" like John Walker Lindh, Jose Padilla, and Yaser Hamdi; many (including myself) were outraged to see US citizens denied their constitutional rights, but we should've been outraged ANYONE was denied rights guaranteed under the Constitution, regardless of their citizenship.

This is still America, folks. We don't just let our leaders point their fingers at people and say, "you're bad111" then proceed to stone them to death. I understand there are people who disagree with that (strongly enough to murder thousands of people, in fact) but to those of my countrymen who feel that way I offer a helpful suggestion:

Rather than trying to turn the US into the Taliban era Afghanistan, why not simply move to a country that's already like that?

The sad and simple truth of the matter is, suggesting we deny people trials since we KNOW they're guilty, just take them out back and have them shot, is no more nor less than a fancy way of saying you agree with bin Ladens methods, just not his motives.
