I would argue that the fight started with the girl, since she knew the rules and tried to violate them anyway, thinking the school wouldn't have the stones to stop her. Well, they did.
So, one should never try to fight an unjust law?
If a police officer tries to illegally search my home, I refuse, and he goes in anyway, I'll end up suing the police department. Am I the one who started that fight?
The girl's lawsuit is saying that the school's actions were wrong, thus she is suing to change them. It's not like she went "Hey! You! Innocent li'l school, minding your own business! I'm gonna getcha!"
