Instead of a negative description where we are defining the choices in a descriptive manner, can we shift to a prescriptive point of view? Sometimes a shift of the style of how we describe the behavior can provide clarity.
If the goal of a judge is to limit your partisanship behavior in external ways to increase trust in the judicary and the rule of law, then was the language choice that Kavanaugh did the best way to "model" the behavior of being non-partisan?
Aka is Kavanaugh here being a role model for other judges where he would want other judges to model their behavior on his example?
