Also, the left at least doesn't go the legislative route on this. It's the right in America that constantly does that.

I've always believed that 'get the legislature to pass a law' is more democratic than 'get the court to invalidate a law', and that the second should only be used as a last resort. Do you have an argument in the opposite direction?
