I've always believed that 'get the legislature to pass a law' is more democratic than 'get the court to invalidate a law', and that the second should only be used as a last resort. Do you have an argument in the opposite direction?


Exactly what free speech law has been invalidated by the courts at the promoting of the left?

Making laws is fine. Making laws designed to chill speech is unconstitutional. Unless you think the First Amendment needs to go, I suppose...
