Legally speaking schools basically have leeway to enforce any dress code so long as they apply it evenly and can demonstrate they are not deliberately being selective in application. I guess a case could be made that if they had a dress code stipulating suits for males and dresses/skirts for females they'd have a pretty solid case.


Isn't that discriminating on the basis of gender? Girls have to wear dresses and boys have to wear tuxedos? I have a problem with that.

There is nothing even about that code. It sounds blatantly selective in application to me.


IIRC, girls skirts boys pants is a perfectly legal dress code, my personal opinion on the matter not withstanding it's definitely legal for a school to have one, or by now the ACLU would have sued the pants off a number of schools, no pun intended, and I believe even private schools would be subject to that sort of case were it not legal. People have a lot of incorrect impression about laws on this stuff anyway. You can in many cases discriminate entirely legally on gender, men don't have to wear shirts on their front lawn, women do. Women don't have to register for the draft, men do, etc.
