that it isn't retroactive. We also have an attribute of the law that an action cannot be made illegal, and then have someone subsequently charged with violating that law.

I'm not a big fan of something being held over someone's head for the rest of their days. Yes, they should be punished for a crime. But in this case, the time for that punishment has come and gone if a crime was indeed performed.
